Terms of Sales

The Court of Monza has the exclusive jurisdiction over any dispute. Any amendment to the above terms and conditions must be approved in writing. All terms and conditions are essential for the supply contract.

 

1. Transport
The supply is delivered on an Ex Works basis. The goods travel at the customer’s risk, even if supplied DAP. The fee for goods delivered CPT charged on invoice will be agreed in every instance.

 

2. Packaging
The price of the supply includes the standard packaging. Any special packaging (pallets, special protection devices, etc.) will be charged separately. We do not accept any returned packaging.

 

3. Deliveries
The date indicated in the order confirmation shall apply for the delivery terms. In case of delay, a penalty of maximum 5% of the value of the goods to be delivered will be applied in favour of the purchaser. The penalties, which go from 1% for every week of delay up to maximum 5%, will be applied from the third week of delay.

 

4. Prices
The final price is that indicated in the order confirmation. The order confirmation does not indicate any cost related to transport, packaging, stamps, fees, etc. These accessory costs are indicated in the invoice.

 

5. Minimum invoice charge
The minimum invoice charge per month is equal to € 50.00. A contribution equal to € 2.5 will be charged for every BR issued for payments with bank receipts lower than € 100.00.



6. Warranty for new products
6.1 The materials supplied are covered by a warranty for 12 (twelve) months from the date of commissioning and not more than 18 (eighteen) months from the date of sale.
6.2 The warranty must be requested in writing (TD, fax, registered letter, etc.). Our technical department will evaluate the legitimacy of the request, and the warranty will be valid only after our acceptance. The warranty does not cover the following products: those subject to improper or abnormal use, defective maintenance, operation beyond the limits indicated in the technical tables, unsuitable environment, application and assembly errors, etc.
In order to assess the legitimacy of the warranty, the product subject to dispute must reach our workshop in the same conditions as it was delivered, i.e. intact, not disassembled, and not tampered with, otherwise, the warranty will be void and null. We will proceed with the repair or replacement of the defective product at our sole discretion. The warranty does not include the transport costs. We will not accept any request for damages for machine downtime, direct or indirect damage, production delays, etc. resulting from the malfunction of our products.

 

7. Warranty for repaired products
The repaired products are covered by a warranty for six months from the date of delivery. The warranty covers the repaired parts only. For the other conditions, refer to paragraph 6.2

 

8. Limits of the warranty
Any damage compensation and any other claim from the client is excluded. The faulty product must be sent to our address free of all charges, and it will be sent back with transport costs charged to the Customer. Any intervention of our technicians outside our premises to replace or repair the material under warranty will be charged to the client. Any intervention or replacement from unauthorised workshops excludes the right to any reimbursement.

 

9. Payments
Payment terms and conditions are indicated in the invoice. The Purchaser cannot suspend or delay payments for any reason whatsoever unless authorised. 1% late payment interests will be charged for every month, or fraction, of delay. In case of a serious delay, besides pursuing legal actions to collect the debt, we have the right to cancel in whole or in part the ongoing orders. Unauthorised rounding or discounts will not be accepted. BR deadlines are always at the end of the month. Deadlines falling on 31 August and 31 December will be postponed automatically to the 10th day of the subsequent month. Administrative requirements do not allow the modification of the indicated deadlines.
